Information on how to enter, the prizes and rules for redeeming the prizes form part of the terms and conditions of entry for the Promotion. Participation in the Promotion is deemed acceptance of these “Terms and Conditions” (“Terms and Conditions”) and any other notices referenced herein.

The Promotion is in no way sponsored, endorsed or administered by, or associated with Instagram (“Instagram”). You understand that you are providing your information to the Sponsor (defined below) and not to Instagram. The information you provide will only be used for the administration of this Promotion and in accordance with the Sponsor’s privacy policy (see below). Instagram is hereby completely released of all liability by each entrant in this Promotion. Any questions, comments or complaints regarding the Promotion must be directed to the Sponsor and not to Instagram.
In these Terms and Conditions, the term “you” refers to any person who enters, or who wishes to enter, the Promotion.

1. Dates/Eligibility: Travelocity’s “Explore18 Giveaway” supply partner promotion (“Promotion”) begins at 8:00 am on Wednesday, December 5, 2018 and ends at 11:00 pm on Thursday, December 6, 2018 (“Entry Period”). Sponsor’s computer is the official time-keeping device for the Promotion. Promotion is open to employees of Global Expedia Supply Partners who are attending the Expedia Partner Conference, Explore18, and who are at least twenty-one (21) years old, have an Instagram account and who otherwise meet the requirements set out in these Terms and Conditions. Employees of Travelocity (“Travelocity”) and its parent company, subsidiaries, affiliates, promotion and advertising agencies, as well as the immediate family (spouse, parents, siblings, and children) and household members of those employees are not eligible to enter or win.

2. Agreement to Terms and Conditions: By entering, you indicate your full and unconditional agreement to (a) these Terms and Conditions, (b) Sponsor’s decisions, which are final and binding, and (c) receiving emails from Travelocity. Winning a prize is contingent upon fulfilling all requirements set forth herein. 

3. How to Enter: During the Entry Period, download the Travelocity app via the iTunes store, the Google Play Store or via the QR code available at the Explore18 Conference, snap a photo somewhere at the Explore18 Conference, and add the virtual Roaming Gnome. Tag @travelocity and use the hashtags #Explore18 and #Promotion on Instagram to enter

Entries will not be acknowledged. There is a limit of one (1) entry per person. Multiple entrants are not permitted to share the same Instagram account. If you attempt to obtain more than one (1) entry by using multiple/different Instagram accounts, identities, registrations or logins, or through other methods, Sponsor may exclude you from participating in the Promotion. When you enter, you are providing information to Sponsor. No purchase necessary.

By entering on Instagram, you agree that your entry conforms to the Submission Requirements as defined below (“Submission Requirements”) and that Sponsor, in its sole discretion, may disqualify you from the Promotion if it believes that your entry fails to conform to the Submission Requirements. Entrants must have permission from all individuals that appear in the entry (if any) to use their name and likeness in the Submission and to grant the rights set forth herein.

4. Submission Requirements: BY SUBMITTING AN ENTRY, YOU AGREE THAT THE ENTRY COMPLIES WITH ALL CONDITIONS STATED IN THESE TERMS AND CONDITIONS. THE RELEASED PARTIES WILL BEAR NO LIABILITY WHATSOEVER REGARDING THE USE OF YOUR ENTRY. THE RELEASED PARTIES SHALL BE HELD HARMLESS BY YOU IN THE EVENT IT IS SUBSEQUENTLY DISCOVERED THAT YOU HAVE DEPARTED FROM OR NOT FULLY COMPLIED WITH ANY OF THESE TERMS AND CONDITIONS AND/OR THE INSTAGRAM RULES.

By participating in the Promotion, each entrant hereby warrants and represents that any Entry he/she submits:
•    does not violate any law, statute, ordinance or regulation;
•    the account will need to be made public to see the specific hashtag; and
•    will not give rise to any claims whatsoever, including, without limitation, claims of infringement, invasion of privacy or publicity, or infringe on any rights and/or interests of any third party.

The Sponsor reserves the right, in its sole and absolute discretion, at any time and for any reason to screen any entry(ies). Any entry that the Sponsor deems, in its sole and absolute discretion, to violate the terms and conditions set forth in these Rules is subject to disqualification.

5. Sponsor’s Rights to Submissions: By entering, you grant Sponsor, and their agents, licensees, and assigns an irrevocable, perpetual (non-exclusive) license and permission to reproduce, encode, store, copy, transmit, publish, post, broadcast, display, publicly perform, adapt, modify, create derivative works of, exhibit, and otherwise use your entry and all elements of such entry, including, without limitation, responses to the questions, as-is or as-edited (with or without using your name) in any media throughout the world, in perpetuity, for any purpose, without limitation, and without additional notification, review, compensation, or approval from you or any other party. You agree that the Sponsor may use the aggregate information collected from the Promotion for related research and marketing purposes.

6. Selection of Winner: On or about December 10, 2018 in Dallas, Texas, at 5400 LBJ Freeway, Suite 500, Dallas, TX 75240, Sponsor will select one (1) potential winner in a random drawing of all entries received during the Entry Period. The odds of being selected depend on the number of entries received. No need to be present to win.

7. Notification and Requirements of Potential Winner: Sponsor’s decisions are final and binding on all matters relating to this Promotion. A potential winner will be notified via direct message on Instagram and asked to provide their email and physical mailing address within 48 hours (the “Initial Notification”). Non-compliance will result in disqualification and an alternate winner may be notified. Within three (3) days of confirmation of the information received from a potential winner in response to Initial Notification, such potential winner will receive a second notification (the “Second Notification”) via email from the Sponsor and will be required to sign and return, within seven (7) days of the Second Notification, an Affidavit of Eligibility, a Liability Waiver, a W-9 form and where allowable, a Publicity Release (collectively, the “Releases”). These Releases will require the winner to furnish his/her Social Security Number for the sole purpose of tax reporting, as required by law. If the potential winner does not reply to the Initial Notification and the Second Notification with the required information and within the specified time period, he/she will be disqualified and an alternate potential winner may be selected in a separate random drawing. A prize is not transferable; no prize substitutions or cash alternatives are allowed except as may be determined by Sponsor in its sole discretion. Except where prohibited, acceptance of a prize constitutes the winner’s consent that his/her name, likenesses, and/or biographical data may be used for advertising and promotional purposes without limitation and without additional notice, compensation, or consent. Only one (1) alternate entrant per prize will be contacted.

8. Prize: One (1) winner will receive a prize that consists of a $2,000 travel voucher for any booking for a flight+hotel package on Travelocity.com (the “Prize”). The travel voucher expires December 6, 2019 and can only be used on one (1) booking. Total Approximate Retail Value (“ARV”) of the Prize: up to $2,000USD. The actual retail value may vary depending on the point of departure, travel itinerary, and costs of air transportation at time of award.

Re-bookings are not allowed. The value of the booking is not refundable. Booking is subject to certain terms and conditions as specified by issuer. Certain blackout dates and travel restrictions may apply.

Winner may book any combination of flight+hotel (depending on the number of travelers, dates and departure location) as long as all travel and accommodations total no more than the value of the voucher. Any booking costs greater than the value of the voucher must be paid for by winner. Travel and accommodations are subject to availability at time of booking and blackout dates. Travel must be round trip. No refund or compensation will be made in the event of the cancellation or delay of any flight, or if winner does not secure the proper travel documents or requirements (i.e., visas, passports, vaccinations, etc.) in time for travel to occur as scheduled. Travel is subject to the terms and conditions set forth by the travel suppliers and Travelocity’s Privacy Policy found at https://www.travelocity.com/p/info-other/privacy-policy.htm.

A winner is responsible for paying any applicable federal, provincial, state, local, income and withholding taxes, if any, and any and all other costs and expenses not listed herein as being provided, including but not limited to all ground transportation, luggage fees, hotel accommodations (if not booked as part of a prize), meals, beverages, tours and excursions, hotel incidentals, souvenirs and gratuities. Tickets may not be eligible for frequent flier miles/points. In the event that any tax withholding is required by law for the prize, winner authorizes Sponsor to make the corresponding deduction. Any prize details not specified above will be determined by Sponsor, in its sole discretion. Sponsor will not be liable for any expenses incurred as a consequence of flight cancellations or delays. Sponsor will not be liable for any airline and/or hotel fees incurred as a consequence of changing or cancelling flight and/or hotel reservations. Sponsor will not replace any lost or stolen prizes or prize components. Winner may not transfer, assign, or substitute the prize, or redeem the prize for cash, except at the sole discretion of the Sponsor, who reserves the right to substitute the prize (or portion thereof) with one of comparable or greater value. Prize is awarded “as is” without any warranty or guarantee, either express of implied by Sponsor.

9. General Conditions: In the event that the operation, security, or administration of the Promotion is impaired in any way, including, but not limited to fraud, Sponsor may, in its sole discretion, either: (a) suspend the Promotion to address the impairment and then resume the Promotion in a manner that best conforms to the spirit of these Terms and Conditions; or (b) award the prize at random from among the eligible entries received up to the time of impairment. Sponsor reserves the right in its sole discretion to disqualify any individual who tampers with the operation of the Promotion, violates these Terms and Conditions, or acts in an unsportsmanlike or disruptive manner. Sponsor reserves the right to seek damages from any person who seeks to undermine the legitimate operation of the Promotion. Failure by Sponsor to enforce any term of these Terms and Conditions shall not constitute a waiver of that provision. The Promotion is subject to federal, state and local laws and regulations and is void where prohibited. Failure by Sponsor to enforce any term of these Terms and Conditions shall not constitute a waiver of that provision. In the event of a dispute as to the owner of an entry, the authorized account holder of the Instagram account used to enter will be deemed to be the entrant. The Promotion is subject to federal, state, and local laws and regulations and is void where prohibited.

10. Release and Limitations of Liability: By participating in this Promotion, the winner grants the Sponsor permission to use their name and likeness for advertising and future promotional purposes without additional compensations (except where prohibited). Winner is liable for any tax liability accruing as a result of this Promotion. No transfer, assignment or substitution of a prize is permitted by any winner. Entrants agree to be bound by the terms of these Terms and Conditions. By participating in this Promotion, entrants agree to release and hold harmless Travelocity, its officers, directors, employees, and agents (the "Released Parties") from and against any claim or cause of action arising out of participation in this promotion, or receipt or use of any prize, including, but not limited to: (a) unauthorized human intervention in the promotion; (b) printing errors; (c) errors in the administration of the promotion or the processing of entries; or (d) injury or damage to persons or property which may be caused, directly or indirectly, in whole or in part, from entrant's participation in the promotion or acceptance, receipt use or misuse of any prize. Entrant further agrees that in any cause of action, the Released Parties' liability will be limited to the cost of entering and participating in the promotion, and in no event shall the Released Parties be liable for attorney's fees. Entrant waives the right to claim any damages whatsoever, including, but not limited to, punitive, incidental, consequential, direct, or indirect damages. By entering this Promotion, entrants acknowledge that they have read and understood and agree to be bound by these terms and conditions.

11. Privacy and Publicity: Any information collected from the Promotion shall be used only in a manner consistent with the consent given by the entrants at the time of entry, with these Terms and Conditions, and with the Sponsor’s Privacy Policy found at http://www.travelocity.com/p/info-other/privacy-policy.htm. Each entrant expressly agrees to the use of his/her personal information for such purpose. The following information will be collected from each entrant for the purpose of administering the Promotion and may also be used by Released Parties and their affiliates to contact the potential winners: entrant name, address and email address. The Released Parties will not sell, share or otherwise disclose information collected in any manner with third parties, other than those parties necessary to fulfill the above purposes, unless entrant has given his prior express consent to receive additional information from the Released Parties or a third party. Entrants have a right of access to, modification and withdrawal of their personal data. Entrants also have the right of opposition to the data collection, under certain circumstances, in accordance with applicable law. The Released Parties will take all steps reasonably necessary to ensure that entrants’ personal information is treated securely and in accordance with Sponsor’s Privacy Policy and these Official Rules.

12. Disputes: You agree that any and all disputes, claims and causes of action arising out of, or connected with, the Promotion or any prize awarded shall be resolved individually, without resort to any form of class action, and exclusively by the appropriate court located in the State of Washington. All issues and questions concerning the construction, validity, interpretation and enforceability of these Terms and Conditions, your rights and obligations, or the rights and obligations of the Sponsor in connection with the Promotion, shall be governed by, and construed in accordance with, the laws of the State of Washington, without giving effect to any choice of law or conflict of law rules (whether of the State of Washington or any other jurisdiction, which would cause the application of the laws of any jurisdiction other than the State of Washington.

TERMS AND CONDITIONS
1.The coupon code has been issued as a prize in Travelocity’s #Explore18 Sweepstakes (the ”Sweepstakes”). It has been awarded subject to the rules of the Sweepstakes and these terms and conditions.
